Introduction and Application of the Privacy Policy

Marani Law LLP, (“Marani Law”) is committed to maintaining high standards of confidentiality and protection of the information that has been provided to us.  The Privacy Policy evidences our commitment to maintaining the privacy of our clients and individuals with whom we interact in the course of business.

Our collection, use and disclosure of Personal Information are governed by applicable privacy legislation as well as our professional obligations as required by the Law Society of Ontario. As legal professionals, we are required to maintain the confidentiality of our clients. The standards provided for in this Privacy Policy are maintained in addition to any professional obligations of confidentiality to which we are already subject.

Please note that in accordance with our Terms and Conditions, any communications or transmission of information to Marani Law or to any member of our firm for marketing purposes or to request information about our firm, through the use of our Website or otherwise, is not intended to create, and receipt of which will not constitute, a solicitor-client relationship.

Personal Information

For the purposes of this Privacy Policy, the term “Personal Information” means any information that is defined to be ‘Personal Information’ under applicable privacy laws. This typically includes information about an identified individual, or information of an individual whose identity may be inferred or determined from the information; however, it typically does not include business contact information.

Collection, Use and Disclosure

Personal Information is any information about an identifiable individual or that permits an individual to be identified. Generally, Personal Information does not include your name, business address or business contact information, such as your business title, email address or phone numbers, which you provide to us for business purposes. Marani Law generally collects Personal Information that you voluntarily provide, but we may collect information from third parties and as agents on behalf of our clients where we or they have obtained the requisite consent, or as otherwise permitted or required by law. We may also collect information through our website, although that information is typically restricted to your name and email address.

We will obtain your consent prior to collecting, using or disclosing Personal Information for any purpose, except where otherwise permitted or required by law. Consent may be provided orally or in writing or may be implied, such as where you continue to provide Personal Information to us in the context of our ongoing relationship, or where you provide members of Marani Law with non-business contact information in connection with our service offerings. By Personal Information to Marani Law, you consent to our collection, use and disclosure of such Personal Information in accordance with this Privacy Commitment and as permitted or required by law. To the extent that you provide Personal Information of another individual to Marani Law, you represent that you have the necessary consent or authority to permit us to collect, use and disclose such Personal Information for the purposes set out in this Commitment.

Marani Law collects, uses and discloses Personal Information primarily to provide advice and legal and other services to clients and prospective clients, for administrative and relationship management purposes (including to develop and manage our knowledge management systems, and to market and deliver our services) and as otherwise permitted or required by law. We may from time to time use third party service providers to perform certain functions for us, such as office services and data processing. In these circumstances, such third party service providers are contractually bound to safeguard the Personal Information transferred to them with measures comparable to that provided by us and described in this Commitment and not to retain, use or disclose Personal Information transferred to them for any purpose other than the provision of services to Marani Law. Personal Information supplied to Marani Law is confidential and we do not distribute such information to any third party except with your consent or as permitted or required by law. Marani Law does not sell Personal Information.

Marani Law only keeps Personal Information as long as it is required for the reasons it was collected or to comply with law or professional standards. We have procedures dealing with the destruction or deletion of Personal Information no longer required for the purposes for which it was collected.

Retention

The amount of time we will retain Personal Information varies, depending on the services we have provided to you and the nature of the Personal Information we hold. This period typically extends past your immediate relationship with Marani Law, but will be only as long as is necessary for us to maintain sufficient information to respond to any issues that arise at a later date and as required by law.  Once the Personal Information is no longer needed, we will utilize the procedures we have in place to safely destroy, delete, erase or otherwise dispose of the information or to convert it into aggregated non-identifying form.

Security

Your Personal Information is treated as private, confidential information by Marani Law and we strive to ensure that your Personal Information, regardless of format, is protected and kept secure at all times. Most methods of communication are not fully secure and security measures may create challenges to the efficient exchange of information. Email is often our preferred method of communication and unless you object we usually use unencrypted plain text emails when communicating with you.

Third Parties

In respect of Marani Law’s use of third party agents, contractors or service providers (the “Agents”), who may receive Personal Information in the course of their work for Marani Law and Marani Law’s delivery of services to you, Marani Law will use contractual and/or other arrangements to ensure that the Agents use the same level of protection of your Personal Information as is required by Marani Law in accordance with this Privacy Policy. The types of services these Agents may be contracted to deliver to Marani Law include, but are not limited to, website hosting, data analysis, newsletter services, credit agencies, promotional activities and other administrative services.

Our Website and Third Party Websites

The only information we collect through our website is the information voluntarily supplied by you if you contact Marani Law through the website. We do not employ any electronic means to automatically collect Personal Information from any visitor or user of our site or from their computers.

Our website contains links to other websites which may collect your Personal Information. Marani Law does not assume any responsibility for the privacy practices, policies or actions of the third parties operating these websites. You should read the privacy policies of these websites and make an informed decision whether or not to provide your Personal Information to the websites' operators.

Amendment to this Privacy Policy

This Privacy Policy is effective as of May 21 2020. However, Marani Law reserves the right to change this Privacy Policy, and any of our policies and procedures concerning our practices for handling Personal Information, without prior notice. We will inform you on our Website if we have amended the Privacy Policy, and any such changes will apply to the information collected as of the effective date of the amendment. The amended Privacy Policy will also apply to Personal Information Marani Law holds prior to the effective date of the amendment.

Accessing Your Personal Information

In providing any Personal Information to Marani Law, whether through the website or otherwise, you consent to the collection, use and disclosure of that information in accordance with this Privacy Commitment. You have the right to verify and amend your Personal Information collected by us. You are also free at all times to withdraw your consent to the collection, use and disclosure of your Personal Information. You have rights to access your Personal Information. These rights are not absolute; however if we deny your request for access, we will provide reasons for doing so. If you wish to access, verify and/or amend your Personal Information or make a complaint under this Commitment, please send us a written notice, by way of written communication, at the address below.
